Data Protection Policy

Within the context of your requests for information, your credit application and the management of the contractual relationship, BERDINVEST, as the controller, collects data about you from you. This data is mandatory for the proper processing of your application, otherwise we will not be able to process it.

Purposes of data collection

This information is collected in order :

To process and execute your contract: your data will be processed for the purposes of granting, credit management, risk management, management of unpaid debts and collection, insurance intermediation, electronic document management and statistical studies. Certain telephone conversations may be recorded for evidentiary purposes. If necessary, your data (contact details, assets and solvency) may be supplemented by specialised partners to secure and collect an outstanding debt. Your data will be used in particular for scoring purposes: scoring is a decision-making process based on statistical models using algorithms to compare your situation with those of people with a similar profile. Scoring processes are used to examine your credit application, to manage it and to manage the commercial relationship with the lender.

The information requested may also be used to update the data already held on you by BERDINVEST for the same purposes as those initially pursued. If you are already a customer, information already held by BERDINVEST in connection with current contracts may be used in connection with the examination of this application.

To comply with legal obligations: Your data will be processed for the purposes of combating money laundering and the financing of terrorism and for operational risk management.

In consideration of the legitimate interest of the data controller :
Your data will be processed for the purpose of preventing irregularities in order to minimise the risk of fraud: any irregular declaration on your part will be processed for the prevention, detection and management of irregularities. During the verification process, the credit application is put on hold. Following the verification of your information, any irregularity found may lead to the refusal of credit and/or the suspension of the right to use your credits previously opened with BERDINVEST.   Within the framework of these fraud prevention treatments, cookies and other tracers are used to collect your navigation and configuration data and to group them together in the form of a technical identifier (device finger printing). This data, as well as the data requested when processing your request, may be transmitted securely to our partner supplier of the technical solution used in order to analyse it and correlate it with the information of other users of this solution in order to assess the risk of fraud linked to your request.
Unless you have objected to this, your data will be used for promotional and commercial prospecting purposes, in particular via profiling processing. Profiling is an evaluation process that makes it possible to analyse, via the combination of data, or to predict certain elements such as your centres of interest, your behaviour, your preferences (…). Profiling processes are used to target offers likely to interest you, and to determine the means and methods of communication to be used. Will be used for profiling purposes, all information collected during your requests and during the contractual and pre-contractual relationship (browsing our website, telephone conversations, emails, chats, …).
Certain telephone conversations or your chats with our advisers may be recorded for training purposes with a view to improving the quality of our services. They will also be used for profiling purposes via semantic analysis in order to improve the commercial relationship. You will be notified in advance of this registration and will have the opportunity to object to it.
Your data may be processed to combat incivility, to improve the customer experience (interactive voice server, satisfaction surveys, etc.), and to detect and manage customers in financially fragile situations (including via profiling).

Data collection and recipients

The information collected is mostly information that you have provided directly to us. However, some information may be collected from third parties, in which case you will be informed.

Within the framework of the procedure for granting credit and/or means of payment, BERDINVEST consults the national file of incidents of reimbursement of credit to individuals (FICP) as well as the central file of cheques (FCC) of the Banque de France.

In the event of an unpaid payment incident, information concerning you may be transmitted to the FICP: you have a right of access to this information at Banque de France counters.

Certain information is also transmitted to service providers and agents for the management and execution of this offer. The information transmitted is only that which is indispensable for the performance of the mission entrusted by BERDINVEST to the service provider or agent.

Commercial prospecting

Unless you have objected via the box in the data collection forms: you may receive commercial offers from us or from our partners by post.

You may also receive commercial offers by e-mail and sms concerning products or services similar to those subscribed to.

Data retention period

Your information will be kept for the duration of the contractual relationship, until the expiry of the limitation periods for all actions related to the conclusion and execution of the contract or to satisfy, where applicable, any obligation related to the processing of this data that may be imposed on the lender.

Your rights

You have at your disposal :

  • A right of review: if your credit application is refused, you have the right to ask BERDINVEST for an interview with a counsellor who is authorised to review your file to give him/her your observations on your personal situation.
  • A right of access to all data about you that is processed by us.
    A right of rectification in the event of erroneous data.
  • The right to object to the processing of your data for marketing purposes.
  • The right to object to the processing. You can object to our processing of your data unless we are obliged to do so in the context of the contractual relationship we have with you (for the execution of your credit agreement), for possible legal proceedings and if there are compelling and legitimate reasons for us to continue processing your data.
  • The right to the deletion of your data. Your data will be kept for the above-mentioned period of time. You can, however, request that certain data be deleted if one of the following reasons applies:
    It is no longer necessary for the purposes for which it was collected.
    You object to the processing and there are no grounds for us to retain the data.
    Your personal data has been processed unlawfully.
    You have the right to have your data processed in a limited way. When you request the correction or deletion of your data or when you object to the processing, during the time your request is being examined by the services concerned (maximum 1 month), you can ask for the processing to be limited and if we only keep your data for possible legal actions. Your data can then only be processed with your consent, except for possible legal proceedings,
  • The right to set guidelines on the fate of your data after your death.

We will consider your request and respond to it unless we are required to retain the data to meet legal obligations or to enable possible legal action.
